These Terms of Operations and Service ("Terms") govern access to and use of the ATHIVEX website, cloud platforms, API connectors, and sovereign engineering suite operated by ATHIVEX Corp Private Limited.

1. Acceptance & Scope of Terms
By accessing our website, requesting a demonstration, enrolling in an evaluation pilot, or subscribing to ATHIVEX products (Bharat PLM, KAAL ALM, Jatayu 3D Viewer, Ramsetu Migration Engine, Siddhi AI, or Vanigam ERP), you agree to be bound by these Terms and our Privacy Policy.
If you are entering into this agreement on behalf of a company or legal entity, you represent that you have authority to bind such entity to these Terms.
2. Software Services & Deployment Options
ATHIVEX provides software solutions designed to unify hardware development workflows, engineering change orders (ECOs), bill of materials, and enterprise resource planning.
On-Premise / Private Cloud
Deploys entirely inside customer firewalls. Maintenance, backups, and security management are governed by the enterprise license agreement.
Managed Cloud / SaaS
Hosted in high-availability, encrypted cloud environments with guaranteed multi-zone redundancy and continuous uptime monitoring.
3. Intellectual Property Rights & Customer Data
- Customer Data & IP: Customers retain sole ownership and all rights, title, and interest in and to their proprietary CAD files, engineering schematics, bill of materials, firmware binaries, and corporate data. ATHIVEX claims zero ownership over your design data.
- ATHIVEX Platform IP: All rights, title, trademarks, patents, software algorithms, underlying code, visual designs, and documentation remain the exclusive property of ATHIVEX Corp Private Limited.
4. Acceptable Use & Security Obligations
Users and subscriber organizations agree not to:
- Reverse engineer, decompile, or disassemble any ATHIVEX proprietary binary unless permitted by law.
- Attempt to bypass authentication mechanisms or security controls protecting ATHIVEX cloud services or endpoints.
- Use the platform for any illegal purpose, including unlawful transmission of restricted technology under international export control laws.
5. Limitation of Liability & Warranties
Except as explicitly stated in a signed Master Services Agreement (MSA) or Service Level Agreement (SLA), ATHIVEX provides the web platform on an "as is" and "as available" basis. ATHIVEX shall not be liable for indirect, incidental, or consequential damages resulting from lost productivity or data operational interruptions.
